Common Legal Questions

Quick answers to what people ask most
Is an FIR the same as being charged with a crime?
No. An FIR only sets the criminal process in motion — it records the information about an alleged offence so police can investigate. Charges are framed by a court much later, only if the investigation produces sufficient material. Many FIRs close at the investigation stage itself, and an FIR can also be quashed by the High Court in appropriate cases.
What is white-collar crime and who investigates it in Delhi?
White-collar crime covers non-violent economic offences like fraud, forgery, criminal breach of trust and money laundering. In Delhi, substantial-value cases are typically investigated by the Economic Offences Wing (EOW) of Delhi Police, while money laundering is handled by the Enforcement Directorate and corporate fraud by the SFIO.
What should I do immediately after an online/UPI fraud?
Report it as fast as possible — call the national cyber helpline 1930 and file a complaint on the National Cyber Crime Reporting Portal (cybercrime.gov.in). Quick reporting increases the chance of freezing the money before it is withdrawn. Also inform your bank, preserve screenshots, transaction IDs and messages, and do not delete any communication with the fraudster.
Can a homebuyer get a refund from a builder under RERA?
Yes. If the builder fails to deliver possession as per the agreement, the RERA Act, 2016 allows the allottee to withdraw from the project and claim a refund with interest, or to continue and claim interest for every month of delay. Complaints in Delhi are filed before the Delhi RERA authority.
Is arbitration faster than going to court?
Generally yes. The Arbitration & Conciliation Act, 1996 sets a statutory timeline for completing arbral proceedings, parties choose their own arbitrator, and hearings are private and flexible. Court intervention is limited, though awards can be challenged on narrow grounds.
